Terms and Conditions ("Terms")

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the https://theprojectonline.wixsite.com/mobile-cleaning website (the "Service") operated by The Miracle Mobile Cleaning ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Our Service may contain links to third-party web sites or services that are not owned or controlled by The Miracle Mobile Cleaning.

The Miracle Mobile Cleaning has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that The Miracle Mobile Cleaning shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Curaçao, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Employee safety

The Miracle Mobile Cleaning reserves the right to remove its employees from your home should the environment become unsafe and our cancellation policy will be apply.

Cancellation Policy

The Miracle Mobile Cleaning policies are designed to promote a consistently reliable experience for customers and technicians alike. While we know schedules can change quickly, rescheduling or skipping a booking with short notices causes technicians to miss out on other job opportunities as well as waste their time and gas.

You can cancel or reschedule 2 hours outside of requested booking time free of charge. Cancelling/Rescheduling a booking less than 2 hours before the assigned time will be subject to an Nafl 15,- non-refundable fee.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Disclaimer

This section lists disclaimers which clarify The Miracle Mobile Cleaning services and work scopes further. These disclaimers support our policy of being transparent and are meant to promote a better understanding with our customers.

Interior Detailing / Cleaning:

Customers are requested to clear their personal items from their vehicle before appointments. The Miracle Mobile Cleaning will not be held responsible for valuables left in the car.

Glove box interiors will not be cleaned and owner contents in glove boxes will not be disturbed.

Child car seat(s) should be removed prior to the appointment if you wish the seat cleaned under the child seat. We are not experts in re-installing child seats to meet specifications.

Exterior Detailing / Cleaning:

The Miracle Mobile Cleaning is not a paint repair or touch up shop and will not be held responsible to fix any paint failures that may occur during cleaning.

General

The Miracle Mobile Cleaning is not liable or responsible for:

• Conditions on trim, plastic, vinyl, leather, carpeting, window tint and exterior paint that compromise the quality and performance of our services. (Such as upholstery tears, discoloration, etc.)

• For Unseen or hidden conditions that might be highlighted once that any of our detailing services had been completed. (Such as dings, dents, scratches, etc.)

• For Malfunction or breakage of any of the vehicle’s mechanical/ electrical/electronic components. (Such as convertible tops, sunroof assemblies, check engine light, overheating, breaks, etc.)

• For malfunction of Personal entertainment electronics while performing our services or once our services had been rendered. (Such as DVD/CD/Tape player, speakers, sub woofer, and custom video system, etc.)

• For Loose/ broken/ damaged parts during the car wash or detail process (such, Plastic Windows, Plastic Trim Pieces, Antennas, Mirrors, Bug Guards, Loose Chromes, Spoilers, Convertible Tops, wipers, etc.)

If you have any particular concern, question or request, please let us know before we start working in your car. Check your car before we or you leave.

Pressure Washing

• Water Usage: By signing this agreement, you agree to provide The Miracle Mobile Cleaning the right to use an on-site water supply as needed to complete the stated project without compensation. If an exterior water supply is required, it will be at an additional charge. It is the customer’s responsibility to make sure the water supply is on and in working order before we arrive. Additional charges will be applied if water is not available.

• Electrical Usage: By signing this agreement, you agree to provide The Miracle Mobile Cleaning the right to use an on-site source of electricity as needed to complete the stated project without compensation. If an exterior source is required it will be at an additional charge.

• Color and Tone Concerns: The properties and species of wood age and weather can greatly affect the resulting color or tone of the stain. Note: Variances may occur on individual boards well as total project as densities and other characteristics vary across and throughout the wood. The Miracle Mobile Cleaning and its associates attempt to represent final finish color and tones as best as possible. While we can often give you an idea of the overall color or tone you must expect some variance in the overall finish.

• Courtesy: While The Miracle Mobile Cleaning is on location and performing work on your property, you are responsible for keeping all children and pets, as well as other individuals away from the work area. Children and pets must be kept off work surface for at least 24 hours after our work is completed. This is for your safety as well as our own.

• Scheduling: Scheduling in a business which productivity relies upon the weather can be difficult. Inclement weather may affect scheduling. We try our best to keep scheduling conflicts to a minimum, however, circumstances that are beyond our control may affect your project start and completion dates. You will be notified of any changes.

• Removal & Replacement of Deck Contents: Removal and replacement of grills, deck furniture, planters and any other items are the responsibility of the homeowner. Should we need to remove items from the deck, we will not be responsible for any damage, breakage or for storage issues. An additional charge may be applied for time and labor devoted to the removal of these items.

• Damages: The Miracle Mobile Cleaning is not responsible for damages due to improperly installed siding, loose shingles or siding, broken or opened windows, improperly sealed windows and doors, wood rot, defective construction, improperly secured wires, loose or improperly installed gutters and leaders and improper caulking. In every aluminum siding case and in some cases with vinyl siding, the sun and weather will bleach the color or cause fading. Power washing, which entails removal of chalky, gritty or failing surface materials may cause the faded aspects of the vinyl or aluminum to stand out. The Miracle Mobile Cleaning will not be responsible for such conditions. The Miracle Mobile Cleaning will not be responsible for loose mortar that may dislodge during the cleaning process.

• Stains: Some stains cannot be removed by power washing. Tree sap, artillery fungus, splatters from stains and paints are examples of materials that cannot be removed by conventional means. We make every attempt to point these areas out to the customer when quoting the project. Sometimes these stains cannot be removed at all.

• The Miracle Mobile Cleaning expects your property to be in good repair and weathertight. This includes, but is not limited to all electrical service including receptacles and light fixtures. Doors and windows shall also be weathertight. The Miracle Mobile Cleaning is not responsible for damages as a result of water infiltration from poor or improper installation, maintenance or repair of electrical related items or doors or windows. The Miracle Mobile Cleaning cannot guarantee removal of artillery fungus from exterior house surfaces.

• Windows may become water spotted as a result of our services. Window cleaning is NOT included.
